Terms of Service

These Terms of Service ("Terms") govern your access to and use of ValidateItnow (the "Service"), operated by ValidateItnow ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. The service

ValidateItnow lets founders generate AI-powered landing pages to validate product ideas, collect waitlist signups, run A/B variants, and view analytics. Features available to you depend on the plan you've subscribed to.

2. Accounts

You must provide accurate information when creating an account and keep your credentials secure. You are responsible for all activity under your account. You must be at least 18 years old to use the Service.

3. Billing and merchant of record

Our subscription billing is provided by Paddle.com Market Limited (and its affiliates), who acts as the merchant of record for all paid subscriptions. Paddle handles your transaction, payment method, invoicing, and the collection of any applicable sales tax, VAT, GST, or similar.

By subscribing, you also agree to Paddle's Buyer Termsand acknowledge that Paddle's name will appear on your card or bank statement.

4. Subscriptions, renewals, and cancellation

  • Paid plans renew automatically each billing cycle (monthly) until cancelled.
  • You may cancel at any time from your billing page. Your access continues until the end of the current paid period; you will not be charged again.
  • Pricing is shown in USD. Paddle may display the equivalent in your local currency at checkout.

5. Refunds

Refunds are governed by our Refund Policy.

6. Acceptable use

You agree not to use the Service to:

  • Publish illegal, infringing, hateful, or deceptive content.
  • Send spam or unsolicited messages to waitlist contacts.
  • Impersonate others or misrepresent your affiliation.
  • Reverse engineer, scrape at scale, or attempt to bypass usage limits.
  • Generate malware, phishing pages, or content designed to defraud.

We may suspend or terminate accounts that violate these rules without refund for the unused portion of the billing period.

7. Your content

You retain ownership of the product descriptions, copy, and other content you provide or generate using the Service ("Your Content"). You grant us a worldwide, non-exclusive license to host, store, display, and process Your Content solely to operate and improve the Service.

You are responsible for ensuring Your Content does not infringe third-party rights or violate any law.

8. Our intellectual property

The Service, including its software, design, and brand, is owned by us and protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to use the Service per these Terms. We grant no rights to our trademarks or trade names.

9. AI-generated content

The Service uses third-party AI models (such as Anthropic Claude or OpenAI) to generate landing-page copy. AI output may be inaccurate, unsuitable, or similar to other generations. You are responsible for reviewing and editing AI output before publishing.

10. Termination

You may delete your account at any time. We may suspend or terminate the Service or your account if you breach these Terms, if required by law, or if continuing to provide the Service becomes commercially impractical. Upon termination, your right to use the Service ends.

11. Disclaimer of warranties

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will meet your needs.

12. Limitation of liability

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us in the 12 months preceding the claim, or USD 100, whichever is greater.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or via the Service before the changes take effect. Continued use of the Service after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Any dispute will be resolved in the competent courts located in India.
